House Rules

House Rules and General Conditions

for Event Visitors

In the interest of a pleasant stay for all involved in events held in the spaces of the WUK - Verein zur Schaffung offener Kultur- und Werkstättenhäuser – hereinafter called “WUK” – please take notice of the following.
Upon entering the WUK, visitors agree with the following house rules and general conditions.


I. Safety
1.  All visitors should contribute to safety during events. In particular, carrying weapons, regardless of which sort, pyrotechnical products or other dangerous objects is strictly forbidden.
2. Possession, consumption, sale or purchase of drugs and controlled substances that fall under the narcotics act are strictly forbidden in WUK.
3. The door personnel are instructed to check for the above and to confiscate both dangerous objects and drugs when the person(s) in question do not leave the premises immediately. There is no compensation for confiscated items, and they will not be returned.
4. When a crime is committed on the premises or in the spaces of WUK, and it comes to the knowledge of WUK, we are obliged to inform the police and, if necessary, also initiate criminal proceedings. Additionally, the perpetrator will be banned from the premises.
5. In the interest of all visitors, we must deny entry to intoxicated or inebriated persons as well as recognisably aggressive visitors (also in the case when they demonstrated such behaviour on a previous occasion).
 6. To ensure the safety of children and other guests, and for the sake of cleanliness, dogs are not allowed to wander around in the courtyard and other public spaces unattended, rather they are to be kept on a leash. Furthermore, a muzzle should be put on the dog upon request of WUK personnel.
7. Parking in the courtyard is not permitted. We ask that you limit the time required for (access to) deliveries as much as possible.
8. WUK opening hours
Monday to Friday: 9 AM to 8 PM, Saturday, Sunday and holidays: 3 PM to 8 PM. The house door is locked latest at 2 AM.
9. Closing time for events
There is a different closing time per event. Please ask the personnel for this information. Generally, the event space is closed to the public a half hour after the end of the event. Upon announcement of closing, the visitors are asked to leave the event space. In the case that the event ends after the official opening hours, the visitors are also required to leave the greater WUK premises.  

II. Emergency Procedures
1. In cases of emergency, the designated emergency exits are to be used.
2. In such situations, there is no handout at the cloakroom.

III. Protection of non-smokers – Smoking ban
1. In accordance with the statutory regulations, a general smoking ban is in effect at all events as well as in all public spaces of the building. Smoking is permitted in the WUK courtyard and in designated areas.
2. Upon non-compliance of the instructions of the personnel, the smoker will be asked to leave the event space. In case of recurrence, renewed access to the event can be denied without claim to compensation for the ticket price.

IV. Entrance and stay
1. The conditions provided for in the “Wiener Veranstaltungs-(stätten)gesetzes” (municipal law for event spaces) are applicable at WUK events.
2. Admission to evening events – with the exception of specially marked events – is open for everyone who is 16 years of age and older. WUK personnel are instructed to randomly check personal identification. Visitors who cannot provide personal identification can be denied entry.
3. Information about the entrance fee can be found on the WUK website –www.wuk.at – or in the WUK monthly folder. Upon purchase of a ticket, a contractual relationship comes into being between the ticketholder and the event organiser exclusively.  The organiser reserves the right to change the date and/or location of the event, or to cancel the event. In this case, the ticketholder can return the ticket at sales price within two weeks after the event date at the respective point of purchase. Ticket return is only possible when the event has been cancelled.
4. There are different types of discount tickets. Information about the respective reductions can be found on the WUK website – www.wuk.at – under the section “Contact”.
5. After the begin of an event, any right to the purchased seat is lost. Under certain circumstances, late admission may only be possible during the intermission.
6. Visitors are free to temporarily leave WUK during an event for which they have paid the entrance fee. Serving this purpose, a control mark proving payment of the entrance fee is stamped in a visible place on the visitor’s arm or hand. Without this stamp, renewed admission to WUK can only be granted upon additional payment of the entrance fee.  
7. It is strictly forbidden to bring animals to public events.
8. Sound, film, video or photographic recordings are only permitted with authorisation.
9. In the case of television broadcasts, visitors grant the broadcasting television network express permission to utilise the recordings without compensation or exceptions.

V. Distribution of flyers, littering and storage
1. The distribution of leaflets and flyers is only permitted when approved by WUK management and/or those responsible for an event.
2. Whoever distributes flyers or leaflets without permission has to carry the costs of removal or cleaning. If there is a subsequent attempt to distribute leaflets or flyers in spite of this clarification, we are obliged to ban him or her from the premises.
3. Littering and storage in public spaces are not permitted. In case of infringement of this rule, the perpetrator has to carry the costs of removal or cleaning. If there is a subsequent attempt in spite of this clarification, we are obliged to ban him or her from the premises.

VI. Cloakroom
1. According to municipal law for event spaces, it is obligatory to deposit any items that might be an obstacle in the case of an emergency. Among others, this includes handbags, briefcases, laptop cases, backpacks and luggage larger than 30 x 30 cm as well as coats, down jackets, umbrellas, walking sticks, skateboards, rollers and similar items.
2. Therefore, visitors to an event at which WUK offers a cloakroom must deposit their wardrobe items for the time of their stay; in return, they receive a cloakroom token.
3. Upon issuing the cloakroom token, WUK assumes liability for deliberate or grossly negligent breach of safekeeping duty by cloakroom personnel during the time of the event.
4. This liability is limited to the present value of the deposited items, with a maximum of €150 per cloakroom token.
5. The deposited items should not contain valuables or cash money. These are, in any case, not subject to WUK’s liability. Visitors deposit such items at their own risk. 
6. The cloakroom personnel return the wardrobe and/or other deposited items upon presentation of the cloakroom token without verification of entitlement.
7. When there is no cloakroom offered, we ask our visitors to take care of their wardrobe themselves. In this case, WUK cannot assume any liability.

VII. Lost and found
1. Please immediately hand over items of any kind found in the WUK spaces to the cloakroom personnel or a WUK staff member.
2. Visitors can ask the cloakroom or security personnel about lost items during an event. At the end of the event, found items are deposited at the WUK information office (tel. +43-1-401 21-0).

VIII. Liability for personal damage or injury
1. Provided further liability is not obligatory by law, WUK’s liability for personal damage or injury occurring within WUK is limited to those damages caused by deliberate acts or gross negligence of WUK personnel.
2. WUK is not liable for damages that occur to visitors by fault of a third party.

IX. Historical building substance

1. The WUK possesses historical building substance. Therefore, we ask everyone to take special care to avoid damage to the building or persons.
2. Damage claims against WUK caused by neglect of the special building structure are excluded, except in cases of deliberate and gross negligence by WUK personnel.

X. Domiciliary right
1. The domiciliary right of WUK is exercised by the responsible manager of WUK or – in case of his or her absence – it is transferred to his or her representative or those responsible for an event.
2. These responsible persons have the right, if necessary, to expel persons who disturb the course of events or do not otherwise conform to these house rules and general conditions. They can declare house bans and take necessary measures in the framework of the domiciliary right.
3. Instructions by WUK personnel have to be complied with in all matters.
4. Persons who have been expelled from an event or who are banned from the premises are not entitled to a refund of the ticket price or other costs connected to an event.

1. Scope of application

1.1 The following General Terms And Conditions (GTC) are effective for all business relations via the online shop of WUK Verein zur Schaffung offener Kultur- und Werkstättenhäuser (WUK) on www.wuk.at.
1.2 Online orders are exclusively received on the basis of these GTC. Possible business or purchasing conditions of the customer are not recognised.
1.3 In the event that individual points of these sales and delivery conditions are void this does not affect the validity of the remaining conditions and the contractual agreements based upon them. The parties will agree upon an applicable clause in place of the void clause, which comes closest to its meaning and purpose.
1.4 Alterations or subsidiary agreements require the written consent and confirmation of an authorised WUK representative and are solely valid for the individual business case.
1.5 The GTC are valid for the sale of tickets for the events offered on the website www.wuk.at.
 

2. Conclusion of the contract

2.1 The contract is always concluded between the customer and WUK.
2.2 The contract, ordering and business language is German.
2.3 The customer’s offer to conclude a contract takes place by correctly submitting and sending the order with the customer’s address as well as the correct submission and sending of all necessary data for payment (required fields are marked with a *).

The customer will receive a confirmation email from WUK, which solely informs the customer that the order has been received. The submission of a correct email address is necessary. The confirmation of receipt is not yet an admission statement and does not indicate anything about the availability of the ordered service.
 
A contract about the delivery of the event services first comes into being when WUK confirms the order per email after having verified the availability and authorisation of the payment withdrawal with the credit card company or bank submitted in the ordering process.
 
In the ordering process the following steps lead to the conclusion of a contract:
1. Selection of event and number of tickets
2. Submission of personal data, selection of payment method and agreement with the GTC
3. Verification of data and placement of order
4. Email from WUK confirming reception of the order
5. A binding confirmation of admission by WUK (after verification of availability and bank authorisation)
 

3. Prices and Fees

Only the prices published on www.wuk.at are valid. WUK has the right to change the prices up to the point of admission confirmation. In the event that the admission confirmation indicates a different price, this is a new offer for the event affected by the price change, which requires a confirmation email from the customer. The respective handling fee and the legally set sales tax are already included in the published prices.


4. Payment conditions

Upon conclusion of the contract the total price of the order including all fees is immediately due. The payment is withdrawn on the day of the completed booking via the electronic payment method selected by the customer (EPS online transfer or credit card: VISA or MasterCard; paybox, provider of the payment transaction: mPay24). WUK does not assume any liability for any damages or losses caused by a sale not authorised by the bank or credit card company.


5. Shipment conditions

5.1 Tickets acquired over the website www.wuk.at can be picked up at the box office on the day of the event upon presentation of the confirmation email or the order code and official photo identification of the customer. It is not possible to receive the tickets by postal delivery.


6. Right of return, exchange, cancellation

The return and exchange of already purchased tickets is excluded. Refunds for unclaimed, partially claimed (e.g. due to arrival after the begin of the selected event) or lost tickets are not provided.
In the case of the cancellation or rescheduling of an event the customer receives a full refund of the ticket price within four weeks of the original event date or a ticket for the event on a rescheduled date.


7. Data Privacy

All data submitted by the customer is automatically encoded (SSL TLS) in the transfer process and treated as confidential. The customer accepts that their electronically submitted data will be electronically processed for the purpose of concluding the contract. The customer gives their consent for the electronic archiving and processing of their data. The customer is aware that this consent may be withdrawn at any time.


8. General information about visiting an event

8.1 Upon admission to an event at WUK the visitor accepts the house rules.
8.2 The conditions stated in the municipal “Veranstaltungs(stätten)gesetz” (law for event spaces) are applicable. Bringing along dangerous or disturbing items as well as animals is not allowed. Contravention justifies dismissal from the event. Outerwear, umbrellas and bags are to be left in the cloakroom. Sound, film and video recordings as well as photography are prohibited. The use of mobile telephones during a performance is not allowed.
8.3 The liability of the event organiser is limited to deliberate action and gross negligence, except in the case of personal injury.


9. Applicable law and place of jurisdiction

Austrian law applies under the exclusion of the international principles on conflicts of law and the UN Convention on Contracts for the International Sale of Goods (CISG). The designated responsible court is that of the 9th municipal district in Vienna.
